These Terms of Use apply to the Noizio apps (the "App"), including Noizio for Android on Google Play and the Amazon Appstore, published by Kyrylo Kovalin ("we", "us", or "our"). They are short on purpose. Please read them.
By downloading or using the App, you agree to these Terms. If you don't agree, please don't use the App.
We give you a personal, non-exclusive, non-transferable license to use the App on your own devices for personal, non-commercial purposes. The App, its sounds, recordings and other content remain ours (or our licensors'). You may not copy, extract, record, redistribute, resell or reuse the App's audio or content outside the App, or reverse engineer the App except where the law allows it.
Some sounds and features are unlocked with a one-time in-app purchase made through Google Play or the Amazon Appstore. We don't process payments. Billing, refunds and taxes are handled by the store under its own terms and policies, so refund requests should go to the store where you bought the App.
Ambient sounds, noise colors and "brainwave" tones in the App are meant for relaxation and focus only. The App is not a medical device and does not diagnose, treat or prevent any condition. If you have a health concern, talk to a doctor. Keep the volume at safe levels, especially with headphones and when listening for long periods or while sleeping.
We may update, change or remove sounds and features of the App at any time. We don't guarantee that the App will always be available, uninterrupted or error-free.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent permitted by law.
To the extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the App, and our total liability to you is limited to the amount you paid for the App.

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continuing to use the App after a change means you accept the updated Terms.
These Terms are governed by the laws of Ukraine, without regard to conflict of law rules. Nothing in these Terms limits rights you have under the consumer protection laws of your country.
